Can You Be Registered to Vote in Two Counties

Absentee ballot

One of the bones tenets of democracy is that each person has ane vote. In practice, state laws vary regarding the definition of "voting more than once" and particularly what happens if a voter casts a election in more than one state.

The Definition of Double Voting

Most commonly, states prohibit voting more than once "in the aforementioned ballot." This tin be interpreted in different ways. Is voting in more than one state but on the same day voting in the "aforementioned ballot"? Or is each state-run election a split up election? What if voting occurred on unlike days, i.e. a voter cast an absentee ballot in one state and voted in person in another state on Ballot Day? Table 1 beneath contains state-by-land statutory linguistic communication. In summary:

  • 12 states explicitly prohibit voting in more than than 1 state: Alabama, Arizona, Colorado, Kansas, Kentucky, Maine, Missouri, New Hampshire, Oregon, South Dakota, Virginia, and Washington.
  • 7 states prohibit voting twice within the state or for the aforementioned office: Alabama, Delaware, Hawaii, Illinois, Maryland, Mississippi and Westward Virginia.
  • 31 states and Washington, D.C., prohibit voting twice in the same election: Alaska, Arkansas, California, Connecticut, Florida, Georgia, Idaho, Iowa, Louisiana, Massachusetts, Michigan, Minnesota, Montana, Nebraska, Nevada, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oklahoma, Pennsylvania, Rhode Island, Southward Carolina, Tennessee, Texas, Utah, Vermont, Wisconsin and Wyoming.
  • In Indiana voting twice is not explicitly mentioned, merely a person may not knowingly use for or receive a election in a precinct other than the precinct in which the person is entitled to vote. And, registering to vote more than one time is a misdemeanor.

Underlying these state statutes is the Voting Rights Human activity's prohibition on "voting more than than once." 52 U.s.C. § 10307(due east). NCSL has been unable to find a prosecution of whatever person under that statute for voting in multiple states at the aforementioned time (for example, voting for state and federal offices in the 2022 election in Land Ten and for land offices in State Y, when the voter owns residences in both states). Thus, the question of whether federal law prohibits such voting practices remains unresolved.

Is Double Voting a Crime?

Double voting is oftentimes listed as a felony in states, and can come with hefty fines or jail fourth dimension. Although statistics show it to be rare, it is besides difficult to identify and hard to prosecute when it does occur.

Information technology is not ever clear when double voting has happened across land lines, given the variation betwixt states' policies. Below are three scenarios for a voter who voted in 2 states on the same federal election date:

  • Neither state prohibits "voting more than than one time."In this scenario, no crime has occurred, because there is no federal statute prohibiting double-voting. Voter registration in multiple states is not itself a crime, and thus no one can be prosecuted for simply having 2 open voter registrations in different jurisdictions.
  • At least one country prohibits "voting more than than once," but the prohibiting state does not define "voting more once." Whether or not the voter violated the law varies by jurisdiction. In a prominent prosecution described below, the voter did not violate the police force. In that 2022 court case, an Arizona woman was charged with casting an absentee vote in Colorado and an in-person vote in Arizona during a midterm election. She was charged in Arizona with illegally voting twice, and was bedevilled past a jury trial. An appeals court overturned her conviction, noting that the Arizona statute as it stood at the time—A.R.S. § 16-1016(2)—did not employ to situations other than voting for an office twice. Because unlike senators and members of the U.S. House were upwardly for election in each state, the court held that the elections were unique to each state, and therefore the voter had not voted twice in violation of the statute. State v. Hannah, 355 P.3d 607 (Ariz. 2015).  In light of the ruling, the Arizona Legislature passed an amendment in 2022 to the statute redefining voting more than once as meaning "knowingly votes in this state in an election in which a federal office appears on the election and votes in some other land in an election in which a federal office appears on the election[,] and the election twenty-four hours for both states is the same date." A.R.Southward. § xvi-1016(four).
  • At least 1 state (New Hampshire) prohibits "voting more than once." New Hampshire defines "voting more than once" to prohibit voting in an election in two or more than states on the same day.: In this scenario, the voter has likely violated the laws of the prohibiting land, and would exist in trouble with the law.

Ways to Prevent Double Voting

States, not the federal government, are charged with overseeing elections. At that place is not a national voter registration list—but state registration lists.

Since the U.S. has a very mobile population and voters rarely inform election officials when they move, voters tin often be on the voter rolls in 2 (or more) dissimilar states at once. Unless states take an efficient way of communicating with ane another, it'due south possible that they may not be able to identify an individual who is on the rolls in ii different states. An e'er-increasing number of states are participating in crosschecks with other states to aid place voters who have moved (more than information found on NCSL's Voter Listing Accuracy page), which can assistance with identifying potential duplicate registrations and by extension, double voters.

Election officials may as well learn that a voter has moved by running a check against the U.S. Postal service's National Modify of Address (NCOA) database. Even if states share data and comport checks with postal lists, though, it can be difficult to identify perfect matches and the number of and so-called duplicate voters may exist inflated.
